Saudi Labor Law: Can I combine sick leave with annual leave?

The Saudi Labor law and its executive regulations are in existence to preserve the rights of all parties in the private sector, and among the most important provisions that is clarified in the Labor law are the types of leave that the worker is entitled to during the validity of his contract with the employer, including sick leave, which is a right of the worker.

1️⃣ How many days sick leave a year in Saudi Arabia?

In the Saudi labor system, there are controls related to sick leave for workers and with advantages higher than the work systems in neighboring countries. The system states that the worker is entitled to sick leave with

  • full pay for the first (30) days
  • with three quarters Pay for the following (60) days
  • without pay for the following (30) days during one year.

A single year means the year which begins from the date of the first sick leave.

Article 117 of the Saudi Labor Law states

A worker whose illness has been proven shall be eligible for a paid sick leave for the first
thirty days, three quarters of the wage for the next sixty days and without pay for the
following thirty days, during a single year, whether such leaves are continuous or intermittent.
A single year shall mean the year which begins from the date of the first sick leave.

 

 

2️⃣ Can Employer terminate you due to your illness?

According to Saudi Labor Law, The worker’s service may not be terminated due to illness before he has exhausted the specified periods of leave stipulated in this system.

Article 82 of the Labor Law

An employer may not terminate the worker’s services on account of illness prior to availing him of the period designated for sick leave as provided for in this Law..”

3️⃣ Can I Combine Sick Leave with Annual Leave?

The worker has the right to request to combine his sick leave with his annual leave.

Article 82 of the Labor Law

“..The worker may request that his sick leave be combined with his annual leave.”

4️⃣ Taking Sick Leave without Actual illness?

Many employees tend to submit fake medical reports to avoid salary deduction for absence from work. They circumvent the regulations by resorting to deceptive methods. The Saudi Government has brought in stricter measures and controls to verify genuineness of the medical certificates. Such types of administrative corruptions are treated as a form of lying, forgery and fraud and could be punishable by the law.
